Welcome to the world of intellectual property
Entering the world of intellectual property as a newcomer can feel like stepping into a labyrinth of legal terms and complex regulations. With a little guidance it becomes much more manageable. IP is not just about legalities: it is about the potential of the human mind and the value it brings to the world.
At its core, intellectual property refers to creations of the mind that have value and deserve legal protection: innovations, inventions, artistic works, brands and confidential know-how. Protecting them encourages people to create and share, and lets them benefit from what they create.
The pillars of IP
| Right | What it protects | How long, typically | Where Darwin helps |
|---|---|---|---|
| Trade marks | Distinctive signs, such as names, logos, slogans, colours and sounds, that identify the goods or services of one business | Renewable every 10 years, indefinitely, while in use | Screen with Genius, clear with GSE, manage with Ignite |
| Patents | New inventions, processes and technical innovations that involve an inventive step and can be applied industrially | Usually up to 20 years from filing, subject to annual fees | Manage the life cycle and annuities in Ignite |
| Designs | The appearance of a product: its shape, lines, colours, texture or ornamentation | Typically renewable in 5-year periods up to 25 years | Manage in Ignite |
| Copyright | Original literary, artistic and creative works, such as texts, music, art, photography and software | Arises automatically; generally the author's life plus 70 years | Register and document works through Ignite online services |
| Trade secrets | Confidential business information and processes that give a competitive edge | As long as secrecy is maintained | Analyse confidentiality clauses with Axiom |

- An economic driver. IP assets are valuable business assets, often the foundation of a company's competitive advantage and revenue.

Seven steps to becoming confident with IP
- Educate yourself. Learn the basics of copyright, patents, trade marks, designs and trade secrets: the purpose and scope of each protection.
- Identify your IP assets. Take stock of the creative works, inventions and brand assets that may qualify for protection: a piece of art, a new product idea, a catchy brand name.
- Research and consult. Work out the best strategy for protecting each asset, and consult IP professionals, such as agents, attorneys or advisers, for advice tailored to your goals.
- Secure protection. Register copyright where possible, file patent applications for inventions and trade mark applications for brands, after checking they are free of earlier rights.
- Be proactive. Watch the market for unauthorised use of your IP and act promptly when you find it.
- Stay informed. Laws, regulations and court rulings evolve; keep your IP strategy up to date.
- Network and collaborate. Share insights and best practice with other professionals, and look for collaborations and partnerships.
